Food License (FSSAI)

FSSAI  – Food Safety and Standards Authority of India, is an organization which detects and governs the food business in India. FSSAI is an autonomous body, established under Ministry of Health & Family Welfare, Government of India. FSSAI is established by the provisions of Food Safety and Standards Act, 2006 which is a consolidating statute in relation of food safety and regulations in India. FSSAI assures the quality of food, by conducting quality checks and curtails the food adulteration. FSSAI lays down all the rules and regulations in India for running of food business. Registration and license of Food Business Operators (FBO) are governed by FSSAI.

It is mandatory to obtain license or FSSAI registration for all food business operators in India. It may include manufacturing units, processing units, storage and distribution units also.

FSSAI is a 14 digit unique registration or license number which needs to be printed on all the packets of food products. Registration procedure is governed by Food Safety & Standards (Licensing and Registration of food Business) Regulations, 2011.

Basic Registration

Requirements 

  • Annual sales of organization up to 12 lakhs 
  • Trade – In India 

Procedure of Registration 

  1. File an application under Form A to Food & Safety department of India 
  2. This application may gets accepted or faces rejection by department, in 7 days from the date of application sent. Reason of rejection must be in writing. 
  3. If application is accepted then a certificate of registration will be granted to applicant along with the registration number and photo of applicant.
  4. FBO is under obligation to display the registration certificate in front of all at business place. 

Requirements 

  • Any person who doesn’t fall under the category of petty food business operator can obtain Central license. 
  • Annual sales of organization above 20 Crores 
  • Trade – worldwide  
  • Manufacturing units must have capacity of 2MT per day
  • Dairy units must sold 50,000 litres per day and 2500MT per annum
  • Vegetable oil processing units must involve more than 2 MT per day
  • Meat processing units must involve in more than 500kg meat per day or 150MT per annum 
  • Wholesaling food products must have turnover more than 30 crores 
  • Retailing involved FBO should have turnover more than 20 crores
  • Distributors involved  should have turnover more than 20 crores
  • Suppliers must have turnover more than 20 crores

Documents for basic registration:

  • Passport size photo 
  • Authority letter

  • Photo Id which is issued by Government Authority 

  • Address proof

  • Food category list

  • Layout plan

  • Equipment list

  • NOC obtained from Municipality 

  • Certification of incorporation 

  • List of all directors or partners 

  • MOA and AOA

  • Test reports of water

  • Import Export code

Central License :

Requirements: 

  • Any person who doesn’t fall under the category of petty food business operator can obtain Central license. 

  • Annual sales of organization above 20 Crores 

  • Trade – worldwide  

  • Manufacturing units must have capacity of 2MT per day

  • Dairy units must sold 50,000 litres per day and 2500MT per annum

  • Vegetable oil processing units must involve more than 2 MT per day

  • Meat processing units must involve in more than 500kg meat per day or 150MT per annum 

  • Wholesaling food products must have turnover more than 30 crores 

  • Retailing involved FBO should have turnover more than 20 crores

  • Distributors involved  should have turnover more than 20 crores

  • Suppliers must have turnover more than 20 crores

  • Application under Form-B

  • Plan of processing unit containing  all details 

  • List of directors or partners along with their details 

  • Equipment list 

  • Food category list

  • Authority letter 

  • Test reports of water

  • Sources of raw material

  • Recall plan, if applicable

  • Certificate of Ministry of Commerce for 100 % EOU

  • NOC issued by FSSAI

  • Import Export code issues by DGFT

  • Form IX

  • Ministry of Tourism Certificate

  • Proof of possession of place of establishment 

  • Partnership deed in partnership or  affidavit in proprietorship

  • NOC from manufacturer and municipality or local body

  • Proof of turnover

  • Declaration form 

 

Documents Required by traders 

  • Passport size photo

  • Copy of rental agreement 

  • Partnership deed in partnership or affidavit in proprietorship

  • NOC from manufacturer

Procedure For Central license :

File an application under Form-B to Licensing Authority.

Application must be filed by Food Business Operator and it should have certain attachments as, self-declaration, affidavit and annexures.

Pay the fees according to the period of obtaining license.

State License :

Requirements:

  • Any person who doesn’t fall under the category of petty food business operator can obtain state license. 

  • Annual sales of organization between 12 lakhs to 20 crores  

  • Trade – In India 

  • Manufacturing units must have capacity of 2MT per day

  • Dairy units must sold 50,000 litres per day and 2500MT per annum

  • Vegetable oil processing units must involve more than 2 MT per day

  • Meat processing units must involve in more than 500kg meat per day or 150MT per annum 

  • Wholesaling food products must have turnover more than 30 crores 

  • Retailing involved FBO should have turnover more than 20 crores

Penalty:

Non-compliance leads to penalty. As every registered person under FSSAI has to comply with rules & regulations under Food safety and Standards Act, 2006. After the inspection conducted by food safety office, he provides marking as:

Compliance, Non-compliance, Partial compliance and Not observed

If food safety officer might issue an improvement notice based upon the reports of inspection. If operator fails to comply with this improvement notice his license may be cancelled. Aggrieved person may appeal to State Commissioner of Food Safety. Decision passed by State Commissioner of Food Safety can be challenged by filing appeal to Food safety appellate tribunal/ High Court.

Quality of food – 2 lakhs

Sub-standard food – 5 lakhs

Misbranded food – 3 lakhs

Misleading advertisement – 10 lakhs

Extraneous matter in food – 1 lakh

Non-compliance with directions of Food safety officer – 2 lakh
