After Filing a Trademark: Examination, Publication and Registration Explained

Folders and a journal on ascending steps illustrating the trademark application stages

Submitting a trademark application starts a process. It does not complete registration. Knowing the stages helps you understand status updates and ask better questions when a response is needed.

Filing and initial checks

The Registry’s published workflow includes filing, digitisation where relevant, and formality checks. A deficiency may require a response before the application progresses. Keep a copy of the submission and the application reference so you can identify the correct record.

Examination

The application then goes through substantive examination. The official workflow allows for an examination report, a reply and, where required, a hearing. Acceptance is therefore not automatic.

If you receive an update, ask for the actual communication and an explanation of what it means. Distinguish a request for information from a final decision, and confirm who will prepare any response.

Publication in the Trade Marks Journal

Accepted applications proceed to publication. IP India describes a four-month period in which third parties may oppose the application. Publication is an important stage, but it should not be described as the registration certificate.

What if someone opposes?

The Registry’s workflow shows a separate opposition route. The application’s progress then depends on those proceedings and their outcome. This is one reason a fixed completion date cannot be promised for every application.

Registration

The official workflow provides for registration when the applicable stages are completed and the application can proceed. Check the actual record and certificate rather than relying on an informal message that the filing is “done”.

Keep a simple application file

  • Application reference and filing copy
  • Applicant and brand details used in the submission
  • Registry communications and response records
  • Publication information, when available
  • Contact details for the person handling the application

Questions worth asking at each update

What stage is the application at? Is action required? Who will take that action? What work is included in the agreed scope? Clear answers make the process easier to follow.

Be cautious about treating a filing acknowledgement as proof of registration. Ask what has actually happened, what remains and what could change the next stage.
