“Which trademark class do I need?” is easier to discuss once you can clearly explain what your business sells. Start with your activities, then assess the classification.
What is a trademark class?
India uses the Nice Classification to group goods and services for trademark registration. Classes 1–34 cover goods, while classes 35–45 cover services. The relevant class and description should reflect the activity for which you seek protection.
Prepare an activity list first
Write down your products and services in ordinary language. Avoid relying only on descriptions such as “online business” or “consultancy”, which leave important questions unanswered.
For each activity, explain what you supply, how customers use it and whether it is already available or planned. If you run several activities under one brand, separate them into a short list.
A product and a service can raise different questions
A founder might describe a business as a “fitness brand”, but that label alone does not explain whether it sells equipment, offers training or provides both. Bring those details to the discussion rather than selecting a class from the broad business label.
This example illustrates the preparation needed; it is not a class recommendation for a particular business.
Do you need more than one class?
IP India’s filing guidance provides for single-class and multi-class applications. Ask which classes are relevant to your actual scope and how the proposed filing and fees are structured.
Check the description, not just the number
A class number is only part of the application. Review the proposed goods or services description and ask whether it accurately represents your activity. Raise any missing activity before confirming the application.
Bring these details to your consultation
- Your exact brand name
- A list of current products and services
- Relevant planned activities
- Any existing applications for the brand
- Questions about the proposed scope and fee breakdown
A clear business description gives your adviser a useful starting point. Class selection alone does not guarantee registration or settle every protection question.
Discuss your filing options
Tell Trade Innovation Services about your brand and business activity. Request a trademark callback to discuss the search, relevant classes and next steps.
