Trademark Registration in India: What to Prepare Before You Apply

Your brand may begin with a name on a notebook. A trademark application needs a more precise picture: who owns that name, what it identifies and how you intend to use it. Preparing these details first makes a filing discussion more useful.

1. Decide exactly what you want to file

Write down the brand name exactly as you use it. If you are considering a logo application, keep a clear version of the artwork ready. Bring different versions to the discussion if your branding is still changing, rather than treating them as interchangeable.

For example, a business might use a short brand name on packaging and a longer company name on invoices. Identify which is the customer-facing identity you want to assess.

2. Confirm the applicant

Prepare the applicant’s legal name, address and business details. The intended owner should be clear before submission. If several founders or businesses are involved, raise the ownership question at the start.

3. Describe your actual business activity

Trademark applications relate to specified goods or services. Prepare a plain-language list of what you sell or provide, including relevant near-term plans. Class selection should follow that activity, rather than a convenient category name.

4. Clarify whether the mark is already in use

An application may be based on proposed use or claimed prior use. Where prior use is claimed, a user affidavit and supporting documents are required. Gather the records you intend to discuss, and avoid guessing a date.

Your preparation checklist

  • Exact brand name and a clear logo, where relevant
  • Applicant identity and address details
  • Description of the goods or services
  • Use information and relevant supporting records
  • Authorisation or category evidence, where applicable

Ask what the quote covers

Request a breakdown of official fees, professional fees and the scope included. Ask whether responses to later objections or other additional work are quoted separately. A clear scope helps you compare proposals meaningfully.

Preparation and a search cannot guarantee registration. They help you identify questions before committing to a filing.
